Waiting for the Spuffyness... and can we say .. conflict of interest.. or something like that... like a reason to declare a mistrial..
Author's Response: You won't have to wait much longer...I promise! Also two attorneys in a personal relationship cannot cause a mistrial. They are on equal footing in the court. Now if there was a relationship between the judge and an attorney or an attorney and client....then that is unethical. Mistrials are only called if:
(1)The court determining that it lacks jurisdiction over a case,
Evidence being admitted improperly,
(2)Misconduct by a party, juror, or an outside actor, if it prevents due process,
(3)A hung jury which cannot reach a verdict with the required degree of unanimity
(4)Disqualification of a juror after the jury is impanelled, if no alternate juror is available and the litigants do not agree to proceed with the remaining jurors.
